1. Introductory Provisions and Definitions
Online services of Cothema s.r.o. are publicly accessible via a website at cothema.com, or other addresses, hereinafter referred to as Online services. Components of Online services also include e-shop, API interfaces and source codes, hereinafter referred to as Components of online services.
The operator of Online services is: Cothema s.r.o. (ID: 03255336), náměstí 14. října 1307/2, Smíchov, 150 00 Prague (hereinafter referred to as Provider).
A customer is considered anyone who directly or indirectly (for example, using automated scripts) uses Online services in any form, hereinafter referred to as Customer.
Unless expressly stated otherwise, Terms of use apply not only to Online services, but also to Components of online services.
The provisions set out in these Terms of use (hereinafter referred to as Terms) are defined primarily for preventive prevention of potential disputes in the future and fulfillment of legislative and contractual conditions of suppliers.
All provisions of the Terms are valid for both paying customers and other website visitors (unless expressly stated otherwise).
2. Terms of Use
By using Online services, the Customer agrees to these Terms without reservation. If the Customer does not agree with the Terms, they must immediately stop using Online services.
The Customer uses Online services entirely at their own responsibility and with awareness of risks that may threaten them.
Unless agreed otherwise, the Provider does not provide any guarantees or compensation (for example, for data loss, inaccuracy of information provided or non-functionality of Online services).
The Customer waives the right to claim compensation for damage, lost profit and other compensation that may arise in connection with the use of Online services.
By providing their data and information, the Customer gives the Provider the right to use them for specified purposes.
If data from Online services are provided by the customer to third parties, the Customer undertakes to ensure compliance with license conditions for such data and takes responsibility for their provision and handling.
3. Purchase via E-shop
3.1. Payment Terms
Payment for ordered services is possible through the payment selection page, to which the customer is referred during the order process.
Payment can be made using payment methods listed on the payment selection page, in one of the following ways: bank transfer, online payment card.
Payment must be made no later than the due date of the order, but no later than on the day of course start (unless otherwise agreed in writing).

The provider of the payment gateway for "Online payment" method is Comgate, a.s. The service provider, Comgate a.s., is a licensed Payment Institution operating under the supervision of the Czech National Bank. 3.2. Delivery Terms
The Customer places and pays for their order through the e-shop, which is subject to these terms.
The order is considered closed at the moment of complete payment by the customer.
The Customer will receive necessary information to use the purchased service within 3 working days from order completion.
3.3. Complaint Procedure
The complaint procedure applies to services purchased within the internet store, which is subject to these Terms
Complaints relate to defects in delivered services compared to the service description that the operator provided at the time of purchase on their e-shop.
The Customer has the right to file a complaint if the delivered services show these defects.
A complaint must contain: Customer's full name, company name (in case of corporate purchase), contact phone and email, order number and specific description of the defect or deficiency that will be submitted for assessment.
A complaint can be filed after complete delivery of ordered services or expiry of the deadline for delivery of these services, but no later than 2 years from delivery.
After receiving the complaint, the customer will receive confirmation of receipt of the complaint.
The complaint will be resolved within 30 days from its filing. If the complaint is not resolved within 30 days from proven delivery to the operator, the customer has the right to request a refund.
4. Personal Data Protection and Privacy
4.1. General Provisions
The controller of personal data is the Operator.
All personal data are stored and processed especially for the purpose of identifying the Customer for use of personalized services and for other purposes related to the use of the Application.
Personal data may be stored on third-party servers for operational purposes.
Personal data will not be provided without explicit consent of the Customerto other third parties for purposes other than operational.

4.2. Revocability of Consent
The processing of this data is governed by the General Data Protection Regulation (GDPR). The Customer has the right to revoke their consent at any time by sending a request to the Provider's Contact email address . The Provider will delete personal data, where nature allows, within the period necessary to process the request.
4.3. Use of Data for Advertising and Analytical Purposes
To improve our website in the UX area, we collaborate with Microsoft Clarity and Microsoft Advertising to record how you interact with our website through behavioral metrics, heatmaps and session recordings. Website usage data is collected using proprietary cookies, third-party cookies and other tracking technologies to determine popularity of products/services and online activity. We also use this information for website optimization, fraud/security prevention purposes and advertising purposes. The Customer agrees that their personal data, such as email address and phone number, may be used in encrypted form (hashed data) for personalized advertising purposes on platforms of Meta Platforms Ireland Limited and Meta Platforms, Inc. (for example Facebook, Instagram). This data will be used exclusively to create target groups for advertising and will not be shared with third parties.
Email, phone, name and other data provided during order and information provided when requesting e-books or other materials are transferred to ECOMAIL.CZ, s.r.o. for the purpose of managing email campaigns and sending marketing communications. The Customer has the right to request deletion of their data from this company's database at any time by contacting the Provider's Contact email address.
5. Final Provisions
Business terms are governed by the legal system of the Czech Republic.
If some provisions cannot be considered valid, the remaining provisions remain valid without changes.
The Provider reserves the right to change the Terms at any time by publishing them on the website.
